U.S. DEPARTMENT OF LABOR ISSUES GUIDANCE ON CHILD LABOR; PAID SICK AND EXPANDED FAMILY AND MEDICAL LEAVE AMID SCHOOL AND CAMP CLOSURES

On June 26, 2020, the U.S. Department of Labor issued two Field Assistance Bulletins to clarify issues relevant to the pandemic’s effects on the workplace. Of particular interest to employers is Field Assistance Bulletin 2020-4, which provides guidance on when an employee qualifies to take paid leave under the FFCRA to care for his or her child based on the closure of a summer camp, summer enrichment program or other summer program for coronavirus-related reasons.

The bulletin along with some updated information on the Department’s FFCRA FAQs is helpful for employers who are seeing an increase in requests for leave now that schools are closed and employees are being asked to return to work. Questions 91 and 93 have been recently added and are particularly relevant.
